These terms govern the use of FishPal AI services provided by Your Company Name. Last updated: March 3, 2026.
1. Scope
These terms apply to all subscriptions, widgets, API services, and support services provided through FishPal AI. Individual written agreements take precedence over these terms.
2. Service Description
FishPal AI provides an AI-based chat and recommendation service for online shops. The service may include catalog crawling, analytics, and optional email delivery features.
3. Customer Responsibilities
You are responsible for the legality and correctness of your shop content, product data, prices, and all user-facing claims. You must only provide lawful data and ensure your own legal pages are complete and up to date.
4. AI Output and Recommendation Disclaimer
AI-generated recommendations are probabilistic and may contain mistakes. You remain responsible for commercial decisions, legal compliance, and final customer communication.
5. Pricing and Billing
Fees, billing cycles, and included usage are defined in your selected plan or order form. Unless agreed otherwise, invoices are due immediately upon receipt and prices are net of VAT.
6. Availability
We aim for high availability but do not guarantee uninterrupted service. Planned maintenance and external service outages can affect uptime.
7. Intellectual Property
All rights in FishPal AI software and branding remain with Your Company Name. You receive a non-exclusive, non-transferable right to use the service during an active subscription.
8. Data Protection
Data processing follows applicable data protection laws, including GDPR. If required, parties will conclude a Data Processing Agreement (DPA/AVV).
9. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body, or health. For slight negligence, liability is limited to foreseeable, typical damages, except where mandatory law provides otherwise.
10. Term and Termination
The contract term and notice period follow your plan or individual contract. Extraordinary termination rights for good cause remain unaffected.
11. Governing Law and Venue
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If both parties are merchants, the place of jurisdiction is the registered office of Your Company Name.
